Terms of Service

1. Acceptance

By installing AutoGift & BOGO ("the app") on your Shopify store you accept these terms. If you do not accept them, do not install the app.

2. What the service is

The app lets a Shopify merchant create gift and discount campaigns - buy X pay Y, gift with order, cart-value threshold, product or collection triggered gift, tiered gifts and volume discounts - and runs them through Shopify's own discount function together with a storefront kit.

3. Your account and access

The app is used through your Shopify admin. You are responsible for who you give access to your Shopify admin, and for the campaigns you publish being lawful and accurately described to your customers.

We may change plan contents and prices. Changes are announced inside the app before they take effect, and they never apply retroactively to a period you have already paid for.

6. Acceptable use

You may not use the app to mislead shoppers about the price they pay, to run campaigns that are illegal where you sell, or to attempt to bypass Shopify's or our systems' technical limits.

7. Intellectual property

The app, its source code, design and documentation belong to Joykek. Your campaign settings and your store data belong to you.

8. Third-party services

The app depends on Shopify's platform, on hosting in Germany and on an e-mail delivery provider. Interruptions in those services can interrupt the app.

9. Warranty

The app is provided as it is. We test each release, and every money-related mechanism is covered by automated checks, but we cannot promise that it will be error-free or uninterrupted in every store and every theme.

10. Limitation of liability

To the extent permitted by law, Joykek's total liability is limited to the amount you paid for the app in the twelve months before the event. We are not liable for indirect or consequential losses such as lost profit.

11. Indemnification

You agree to hold Joykek harmless against claims arising from campaigns you configured, from the products you gave away, or from your use of the app in breach of these terms.

12. Termination

You may uninstall the app at any time; the subscription ends at the close of the current billing period. We may suspend the service if these terms are breached or if payment fails, after telling you why.

13. Support

Support is provided by e-mail at info@joykek.com and through the support form in the app, in Turkish and in English, on business days.

14. Governing law

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul (Anadolu) have jurisdiction.

15. General

If a clause is found invalid, the remaining clauses stay in force. These terms, together with the Privacy Policy, are the whole agreement between you and Joykek about the app.

Kullanım Şartları

1. Kabul

AutoGift & BOGO'yu ("uygulama") Shopify mağazanıza kurarak bu şartları kabul etmiş olursunuz. Kabul etmiyorsanız uygulamayı kurmayın.

2. Hizmet nedir

Uygulama, bir Shopify satıcısının hediye ve indirim kampanyaları kurmasını sağlar - X al Y öde, siparişe hediye, sepet tutarı eşiği, ürün veya koleksiyon tetikleyicili hediye, kademeli hediye ve miktar indirimi - ve bunları Shopify'ın kendi indirim fonksiyonu ile bir vitrin kiti üzerinden çalıştırır.

3. Hesabınız ve erişim

Uygulama Shopify yöneticiniz üzerinden kullanılır. Shopify yöneticinize kime erişim verdiğinizden ve yayınladığınız kampanyaların hukuka uygun olup müşterilerinize doğru anlatılmasından siz sorumlusunuz.

Paket içeriklerini ve fiyatları değiştirebiliriz. Değişiklikler yürürlüğe girmeden önce uygulama içinde duyurulur ve halihazırda ödediğiniz döneme geriye dönük uygulanmaz.

6. Kabul edilebilir kullanım

Uygulamayı, alıcıyı ödeyeceği tutar konusunda yanıltmak, satış yaptığınız yerde hukuka aykırı kampanyalar yürütmek ya da Shopify'ın veya sistemlerimizin teknik sınırlarını aşmaya çalışmak için kullanamazsınız.

7. Fikri mülkiyet

Uygulama, kaynak kodu, tasarımı ve dokümantasyonu Joykek'e aittir. Kampanya ayarlarınız ve mağaza verileriniz size aittir.

8. Üçüncü taraf hizmetler

Uygulama; Shopify platformuna, Almanya'daki barındırmaya ve bir e-posta gönderim sağlayıcısına bağlıdır. Bu hizmetlerdeki kesintiler uygulamayı da kesintiye uğratabilir.

9. Garanti

Uygulama olduğu haliyle sunulur. Her sürümü test ediyoruz ve parayla ilgili her mekanizma otomatik kontrollerle korunuyor; yine de her mağazada ve her temada hatasız ve kesintisiz çalışacağını taahhüt edemeyiz.

10. Sorumluluğun sınırı

Hukukun izin verdiği ölçüde Joykek'in toplam sorumluluğu, olaydan önceki on iki ayda uygulama için ödediğiniz tutarla sınırlıdır. Kâr kaybı gibi dolaylı zararlardan sorumlu değiliz.

11. Tazmin

Kurduğunuz kampanyalardan, hediye ettiğiniz ürünlerden ya da uygulamayı bu şartlara aykırı kullanmanızdan doğan taleplere karşı Joykek'i sorumlu tutmayacağınızı kabul edersiniz.

12. Fesih

Uygulamayı dilediğiniz zaman kaldırabilirsiniz; abonelik içinde bulunduğunuz fatura döneminin sonunda biter. Bu şartların ihlali ya da ödemenin gerçekleşmemesi halinde, sebebini bildirerek hizmeti askıya alabiliriz.

13. Destek

Destek, iş günlerinde Türkçe ve İngilizce olarak info@joykek.com adresinden ve uygulama içindeki destek formundan verilir.

14. Uygulanacak hukuk

Bu şartlar Türkiye Cumhuriyeti hukukuna tabidir. İstanbul (Anadolu) mahkemeleri ve icra daireleri yetkilidir.

15. Genel hükümler

Bir madde geçersiz sayılırsa diğerleri yürürlükte kalır. Bu şartlar, Gizlilik Politikası ile birlikte, uygulamaya ilişkin olarak sizinle Joykek arasındaki sözleşmenin tamamıdır.
